First, congratulations on taking the bold step to refinance your home! When it comes to homeownership, the only thing greater than buying a home is refinancing your mortgage, which provides you the opportunity to save money and/or use the equity in your home for various purposes available to you.

Your lender likely recommended our office because they’ve worked with Shaffer Law Office in the past. It is important to note that while lenders may recommend a closing attorney for a refi, it is your right to shop around and interview attorneys before agreeing to work with one.

While I can’t speak for other attorneys, here’s what I can tell you about how Shaffer Law Office works with clients who are refinancing their mortgage:

All refinance transactions start with a Title Exam Review, which typically covers your property’s last two ownership transfers. The title exam validates that all prior mortgages, particularly the mortgage(s) of the party who sold you your home, have been properly discharged and that there are no tax or other liens on the property.

Title Insurance also comes into play in the refinance process. While you likely purchased a title insurance policy when you bought your home, your lender will require a new one because the terms of your loan have changed. Our office will handle writing the new policy with the title company, the cost for which will be included on your closing statement.

Speaking of closing statements, our office will coordinate with your lender to draft the closing statement and review it with you before your actual closing. We’ll also work with you to schedule your closing, which can occur at your home, our office, or a mutually agreed upon location.

We also coordinate the funding of your refinance. All closings for the refinance of one’s principal residence come with a three-day right of rescission, meaning that there is a three-day wait period before your refinance is funded.

After the right of rescission period, our office manages all aspects of your refinance funding. We coordinate the payoff of your prior mortgage and record the new one with the Registry of Deeds. If you’ve opted for a cash-out refinance, we will coordinate the transfer of funds to your bank account.

Finally, when our office receives the discharge of your prior mortgage, we record that with the Registry of Deeds, and the transaction is complete.
